State environmental regulators in Mississippi have targeted Elon Musk's SpaceXAI with potential penalties reaching $6.1 million over alleged construction permit violations at three data center facilities. Authorities claim that building activities began at these sites before the company acquired the necessary stormwater authorizations, triggering daily fines of up to $25,000.

The enforcement notices issued by the Mississippi Department of Environmental Quality focus on MZX Tech LLC, a local subsidiary managing the infrastructure. The impacted properties include operational complexes named Macrohard and Macroharder, alongside a third development site known as Minihard. Although these facilities handle operations connected to Memphis, Tennessee, their geographic footprint across the state line places them firmly under Mississippi environmental jurisdiction.

Regulatory filings reveal that SpaceXAI is currently negotiating a potential settlement to consolidate these matters into a single agreement. Meanwhile, the company deals with separate legal battles regarding gas turbine operations at its Southaven facility, where a lawsuit filed by the NAACP alleges air pollution violations under federal and state rules. Federal attempts to dismiss that particular case were recently rejected by a US District Judge, allowing the environmental litigation to proceed.
